Timeframe for raising a Personal Grievance relating to Sexual Harassment has been extended

Effective from 13 June 2023, the Employment Relations Act now provides an extended timeframe for employees to raise a personal grievance relating to sexual harassment. 

The legislation now grants employees a 12-month timeframe to raise a personal grievance relating to allegations of sexual harassment.  

If an employee is seeking to rely on this new timeframe, they will need to show the alleged action relating to sexual harassment occurred on or after 13 June 2023.  The 90-day timeframe will apply to any instance occurring prior to 13 June 2023.

The 90-day period for all other personal grievance claims remains unchanged.

As of 13 June 2023, employers are required to update policies and Employment Agreements to reflect these changes.
